Welcome to the website www.meivr.pt, which is a booking website for Madeira Immersive Experiences, operated by the company "Oceano Panorâmico - Trading, Serviços e Investimentos, Lda".
The site consists of providing access to the Online Shop via the address www.meivr.pt which, in addition to providing information on a range of services, allows the user to book the services offered electronically, under the terms and conditions described here. By accessing and using this site, the user agrees to comply with and be bound by the terms and conditions described herein. If you do not agree with any part of these terms and conditions, please contact our services and do not use our website.
1. Definitions
- Service refers to the virtual reality experiences offered on our website and in the Online Shop.
- User refers to the person accessing or using the site or the Online Shop.
- We, Our refer to the virtual reality space: Madeira Immersive Experiences.
- Company refers to the company that owns and operates the space: Oceano Panorâmico - Trading, Serviços e Investimentos, Lda.
2. Use of the site
The user of the site must:
- Be at least 18 years old or have the consent of their parents or guardians to use this website or the Online Shop.
- Accept that all elements and information transmitted by them will enjoy full legal effect, recognising electronic purchases and not being able to claim lack of signature for non-compliance with the obligations assumed.
- Agree to use the website and Online Shop only for legal purposes and in accordance with these Terms and Conditions.
- Accept the prohibition on using the site in any way that may damage, disable, overburden, impair the site, or interfere with the use of any other part of the site.
- Agree not to use any software or device that may interfere with the operation of the website and the Online Shop, or impose an unreasonable load on our infrastructure.
3. User Account
The user of the site accepts that:
- To access some parts of the Service, you may need to create an account.
- You are responsible for maintaining the confidentiality of your account, password and for restricting access to your computer.
- You agree to accept responsibility for all activities that occur under your account or password.
- You agree to provide accurate and complete information when creating the account and must keep it up to date.
4. Purchases and Payments
You agree that:
- All purchases made on our website and Online Shop are subject to our acceptance.
- We reserve the right to refuse or cancel any order for any reason, including, but not limited to, unavailability of the service, errors in the description or price of the service, or errors in your order.
- Prices are subject to change without notice, but bookings and orders placed prior to the price change will stand.
- We accept various payment methods. All payments must be made at the time of ordering.
- In the event of suspected fraud, we reserve the right to cancel any transaction and report the fraud to the relevant authorities.
5. Rebooking, Cancellation and Refund Policy
At the user's request, they can reschedule or cancel and refund their order by contacting the company by email or telephone (but later confirmed by email), quoting the order number, which will be accepted, provided that the request is made at least 24 hours before the scheduled time for the visit to Madeira Immersive Experiences.
For the purposes of rescheduling or cancellation and refund, the user must provide the following information:
- Order number;
- VAT number with which you placed the order and booking address;
- Bank details for the refund.
At the company's discretion, it reserves the right not to process orders, not to reschedule, not to cancel and not to refund, when it finds:
- Any inconsistency in the personal data submitted or observes misconduct on the part of the buyer;
- If the user does not comply with our criteria for rebooking, cancellation and refund;
- In the event of errors in the values and/or characteristics of the products, when these are the result of technical problems or errors beyond the control of the company.
In the event of rescheduling, cancellation or refund of a service, our liability is limited to refunding the amount paid for the service, and we are not liable for any other costs or expenses.
6. Limitation of Liability
The company guarantees compliance with the law, but limits its liability in the following terms:
- All services commercialised on the website and in the Online Shop are in accordance with Portuguese Law.
- The website and Online Shop have adequate levels of security, however use of the website and Shop is at your own risk.
- The site and Store are provided "as is" and "as available" without any warranties of any kind, either express or implied.
- We do not warrant that the website and Online Shop will be available on an uninterrupted, secure or error-free basis, nor will we be liable for any losses suffered by you as a result of such delays, interruptions, errors and suspensions of communications, which originate from factors beyond our control.
- We do not guarantee that any information, whether oral or written, obtained by the user through the service will create any additional guarantee that is not expressed in these Terms and Conditions.
- We shall not be liable for any indirect, incidental, special or consequential damages arising out of the use or inability to use the site, the Store or the service; the difficulty of obtaining any substitute and; unauthorised access to or modification of personal databases.
- Our liability for any claims relating to the Service, the website or the Online Shop is limited to the amount you have paid for the Service in question.
7. Consumer obligations
The user undertakes to:
- Provide correct personal data and addresses;
- Not use false identities;
- Respect the order limits imposed;
- Not use the products and services purchased in the Online Shop for commercial purposes, namely for the purpose of reselling services or goods.
If any of the data is incorrect or insufficient, and for this reason there is a delay or impossibility in processing the booking, the responsibility lies with the user, and we decline any responsibility in this regard.
In the event that the user violates any of these obligations, we reserve the right to eliminate future purchases, block access to the website and the Online Shop, cancel the provision of any other services made available to the same user at the same time; and also not allow the user future access to any or all services made available by the company.
8. Privacy and Data Protection
The company guarantees the confidentiality of all data provided by users.
The personal data identified on the order form as having to be provided is essential for the company to provide the Service. The omission or inaccuracy of the data provided by the user is the user's sole and entire responsibility and may result in the company refusing to provide the Service.
The user's personal data will be processed and stored by computer and is intended to be used by the company within the scope of the contractual and/or commercial relationship with the user and, if authorised by the user, for the marketing of entertainment services and virtual reality experiences.
Under the terms of the applicable legislation, the user is guaranteed, free of charge, the right to access, rectify and update their personal data, directly or by written request, as well as the right to object to its use for the purposes set out in the previous paragraph, and for this purpose should contact the entity responsible for processing personal data: Oceano Panorâmico - Trading, Serviços e Investimentos, Lda.
The Internet is an open network, so the user's personal data, other personal information and all the content hosted on the Service may circulate on the network without security conditions, even running the risk of being accessed and used by unauthorised third parties, and the company cannot be held responsible for such access and/or use.
9. Intellectual Property
The Online Shop is a registered site and the Service provided by the site itself is the responsibility of the company.
The user recognises that the Service contains confidential information and is protected by copyright and related rights, industrial property and other applicable legislation.
The user acknowledges that any content appearing in advertising, highlighting, promoting or mentioning any sponsor or advertiser is protected by copyright and related rights laws, industrial property laws and other property protection laws, and that any use of such content may only take place with the express authorisation of the respective owners.
The user undertakes to fully respect the rights referred to in the previous paragraph, namely by refraining from any acts that may violate the law or these rights, such as the reproduction, commercialisation, transmission or making available to the public of this content or any other unauthorised acts that have the same content as their object.
The user grants the company "Oceano Panorâmico - Trading, Serviços e Investimentos, Lda" a non-exclusive, irrevocable, royalty-free licence to use any suggestions, feedback or ideas provided by the user in relation to the site, the Online Shop or the Service.
10. Service Security Conditions
The user undertakes to comply with all applicable legal provisions, in particular not to practice or encourage the practice of illegal acts or acts that offend morality, such as the indiscriminate sending of unsolicited communications (spamming) in violation of the provisions of the legislation applicable to the processing of personal data and advertising communications through automatic calling devices.
The user expressly recognises and accepts that the IP Network is a public electronic communications network that may be used by several users, and as such is subject to computer overloads, so the company does not guarantee that the Service will be provided without interruptions, loss of information or delays.
The company also does not guarantee the provision of the Service in situations of unforeseeable overload of the systems on which it is based or of force majeure (situations of an extraordinary or unforeseeable nature, external to the company and which it cannot control).
In the event of an interruption in the provision of the Service for reasons of unforeseeable overload of the systems on which it is based, the company undertakes to regularise its operation as soon as possible.
11. Suspension and deactivation
Irrespective of any prior or subsequent communication, the company may, at any time and in its sole discretion, discontinue making the Service and/or part of the Service available to one or all users.
The company also reserves the right to immediately suspend or terminate access to the Service in the following cases:
- When the user does not comply with the conditions of use;
- When the company ceases access to the Shop, with prior notice of 15 days before the date of cessation.
The suspension or termination of the Service by the company, under the above terms, shall not entitle the user or third parties to any indemnity or other compensation, and the company shall not be held liable or in any way encumbered for any consequence resulting from the suspension, cancellation or termination of the Service.
12. Communications
Without prejudice to other forms of communication provided for in these Terms and Conditions, notifications to the user relating to the Service, including any changes to these Terms and Conditions, may be sent to the user's e-mail address.
The user agrees to receive any communication and/or notification related to the website and the Online Shop at the address, contact telephone number and/or e-mail address ("e-mail") indicated in the order process.
13. Technical configurations
The company may change the website, the Online Shop, the Service and/or the technical conditions under which it is provided, as well as the respective rules of use, but the changes will only have practical effect for orders placed from that date onwards.

14. Complaints
The user can submit any contractual disputes to the arbitration and mediation mechanisms that are or will be legally constituted, as well as complain to the company about acts and omissions that violate the legal provisions applicable to the purchase of goods, or through the online complaints book, with the link https://www.livroreclamacoes.pt/inicio.
The complaint must be submitted within a maximum of 30 (thirty) days from the time the user becomes aware of the facts, and will be registered in the company's information systems, which must decide on the complaint and notify the interested party within a maximum of 30 (thirty) days from the date of receipt.
15. Applicable Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of Portugal.
Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Funchal.
If any provision of these Terms and Conditions is held to be invalid or unenforceable by a competent court, the remaining provisions shall remain in full force and effect.
